These terms apply when you download, install, trial, purchase, or use Hibiscus. By using Hibiscus, you agree to these terms. If you do not agree, do not install or use the software.

Your Hibiscus license
Hibiscus is licensed, not sold. A personal license may be active on up to two Macs owned and used by the same person unless the offer shown at purchase says otherwise. You may not resell, sublicense, distribute, reverse engineer, or use Hibiscus to violate another person’s rights or applicable law.

Trials, purchases, and updates
The seven-day trial does not require a payment card. Paid plans, prices, included update periods, and any future upgrade options are the ones shown when you purchase. Payment details are handled by Stripe. Taxes, currency conversion, and any non-waivable refund or cancellation rights provided by applicable law continue to apply.

Your notes and your responsibility
You retain ownership of the notes and files you create or import. Hibiscus is designed to keep its local note library on your Mac, but you remain responsible for your device, passwords, backups, exported files, and the content you choose to process or share.

AI and third-party services
Hibiscus can use on-device models, local services such as Ollama, or providers you choose. When you select a connected provider, the data you send is also governed by that provider’s terms and privacy practices. Provider availability, output quality, and usage charges are outside Hibiscus’s control. AI output may be incomplete or inaccurate and should be reviewed before you rely on it.

License and purchase data
Trial activation, license activation, and license checks may send an installation identifier, device name, app version, and license details to the Hibiscus licensing service. Purchases use your email for license delivery and purchase-related verification. These requests do not include your note content or attachments. Availability and updates
We may improve, change, suspend, or discontinue features. An existing perpetual license continues to cover the version and update period included with the plan you purchased. We do not promise that every feature, model, provider, or operating-system integration will remain available forever.

Warranty and liability
Hibiscus is provided on an “as available” basis to the fullest extent permitted by law. We do not guarantee uninterrupted operation or error-free AI output. To the fullest extent permitted by law, Hibiscus is not liable for indirect, incidental, special, consequential, or lost-profit damages. Nothing here limits rights or liability that applicable law does not allow us to limit.

Changes and contact
We may update these terms when the product or legal requirements change. The updated date below will identify the current version. Material changes apply prospectively. Questions about these terms can be sent to [email protected].
